
New Jersey Senate Bill S1370 has passed, mandating mercury-free certified flooring for all new installations, repairs, or upgrades in schools, community centers, and child care centers.
It prohibits construction permits unless materials are manufacturer-certified mercury-free and addresses legacy risks from 1960s–2000s polyurethane floors that release mercury vapor, leading to gym closures in 2017–2019.
For existing floors, compliance requires certification, air-quality testing to meet DOH limits, mitigations like HVAC adjustments, or DEP-approved removal if levels remain high. Penalties for false certifications reach $25,000, with DOH/DEP maintaining a public compliance database and periodic retesting. This builds on 2019 Schools Development Authority standards and DOH guidance, prioritizing child safety.
